Protection of Personal Information Policy

Protection of Personal Information Act “POPIA” deals with your constitutional right to privacy and the right to access of information which was signed into law by the President on 1 July 2020 to be effective by 1 July 2021 and much work has taken place behind the scenes in preparation for this deadline.

We care about the privacy, security, and online safety of your personal information and we take our responsibility to protect this information very seriously. Below is a summary of how and why information is collected, how it is processed, shared, stored, as well as access to this information.

Sport Injury Guardians (Pty) Ltd, has always been committed to treating your information in an ethical manner and POPIA provides the legal framework and requirements for this treatment. All companies, including Sport Injury Guardians (Pty) Ltd, are now obliged by law to deal with client information with far more diligence than ever before.

We confirm POPIA in no way affects any terms and conditions of your current cover, only how we are required by law to process your personal information which already has been standard practice at Sport Injury Guardians (Pty) Ltd.

What is Lawful Data Processing?

Terminology:

  • Data Subject: the person the data is about, you our valued client.
  • Responsible Party: our business Sport Injury Guardians (Pty) Ltd.
  • Operator: the group that processes the information for the Responsible Party. This is the Insurer.

The Responsible Party must take accountability to comply with the POPIA. We are committed to processing your personal information in accordance with relevant legislation. Please feel free to contact us for our policies and procedures.

The Responsible Party must have a good reason for processing Personal Information, such as consent from the Data Subject and the Data Subject must know why the Responsible Party is processing their Personal Information. Your personal information provided to us is collected for the purpose of your membership benefits. We can only provide sound financial advice and perform intermediary services with full disclosure of relevant information relating to appropriate personal, including private, information for the purposes of determining and advising on your financial needs, including but not limited to any information relating to or interest in any of the membership benefits.

The Responsible Party can only process Personal Information again, if it is for the same purpose, they got consent from the Data Subject for. We share your relevant Personal Information with other role players (Administrators, Underwriters and/or Insurers), industry bodies, credit agencies and/or service providers only for the purpose as discussed and consent obtained for. We provide your personal information to the insurers in the event of a loss, so that you can institute a valid claim.

The Responsible Party oversees ensuring the Personal Information they process is correct and complete. We are required to collect and process current and up to date information, which is authentic and accurate. Please always remember to disclose all material facts to us.

The Responsible Party must be open with the Data Subject about how they are processing their Personal Information, in such a way that they know what is happening to their information (if applicable and no agreements of such exists then Sport Injury Guardians (Pty) Ltd can confirm). We use your information as stated above and confirm we have no agreement with, nor do we provide or make available your personal information for any direct marketing purposes.

The Responsible Party is charged with the security and protection of Personal Information they collect and must implement reasonable security measures. We take every reasonable precaution to protect your personal information from theft, unauthorised access, and disruption of services.

The Responsible Party must communicate with the Data Subject about processing their Personal Information and allow them to correct or update their information. You may amend, update, change or correct your personal information processed by us.

You may request to view your personal information held by us and we shall make same available to you.
